1 OAK clubs suing L.A. nightclub booker in trademark dispute

The swank 1 OAK nightclubs in Las Vegas and New York are suing a California man they claim is infringing on 1 OAK trademarks.

Butter IPH LLC, a 1 OAK holding company, filed suit Friday in federal court in Las Vegas against Jayson Sanchez, who has a company in Los Angeles called "1oak Entertainment Group.''

Butter IPH says in the suit that its 1 OAK in New York City is one of the hottest nightclubs there and is ''synonymous with glamour, luxurious excess, fame and fortune.''

It says the Las Vegas 1 OAK club, which opened at the Mirage on Jan. 1, is ''the hottest new nightclub in Las Vegas.''

That property at the former Jet nightclub location is operated in partnership with the Light Group.

Friday’s lawsuit says Sanchez and his company have adopted and are using 1 OAK’s federally pending "1 OAK One of a Kind'' design and work trademarks without authorization.

The suit says Sanchez and his firm use the trademarks in connection with an artist and music management company that books musical acts at nightclubs, restaurants, bars and lounges throughout the country. The holding company is seeking an injunction blocking Sanchez from using the "1oak" name.

"The defendants could have adopted a mark that did not include '1 OAK' and/or 'One of a Kind' (elements), such as Entertainment Group or Sanchez Entertainment Group, or any of a host of other names that would not have infringed upon Butter’s rights," the suit says. "Instead, by using Butter’s marks, the defendants are trading off of Butter’s goodwill and reputation."

A request for comment was placed with Sanchez.
